Laws And Policies Affecting Addiction Treatment In Massachusetts

In October 2019, Massachusetts Department of Public Health revised its treatment protocols for the states Department of Corrections programs and facilities. The new treatment protocols require voluntary, informed consent for patients in custody who will receive medication-assisted treatment for opioid use disorders.

Program physicians must inform patients in custody of the use of opioids for medication-assisted treatment and their individual opioid use disorder diagnosis.

Qualified program physicians must explain the nature of the FDA-approved medication that is recommended, and must ensure that patients understand the health benefits and risks.

Patients must also be provided with alternative treatment options, as well as the approximate individualized treatment program length that providing physicians are recommending.

Determining what consumers value when they receive health care services is an important activity in helping to improve the quality of those services. JSI worked closely with the Massachusetts Bureau of Substance Abuse Services to develop, implement, and analyze results from a consumer/client satisfaction tool. JSI collaborated with the Performance Management Advisory Group of consumers and providers, convened by BSAS, throughout the development process. JSI reviewed existing consumer feedback, and engaged consumers to solicit feedback as we developed topics and content for the tool. JSI also researched a range of client satisfaction tools in addition to those preliminary tools that have been identified .

We anticipate this consumer/client satisfaction tool will focus on indicators such as: access to care, quality/appropriateness of care, general health and safety , quality of food, and quality of physical space. With respect to implementation, JSI took into consideration the varying lengths of the different programs, as well as the fact that some programs are outpatient while others are inpatient. JSI considered various modes of data collection and also determined the most appropriate point during a consumer’s course of treatment to complete the survey. Dissemination of results are in progress.

Specialized Residential Services For Families

Specialized Residential Services for Families provide a safe and supportive treatment environment for homeless families when the caretaking parent has a chronic substance addiction problem. Programs provide shelter, coordination and case management of substance addiction treatment and other services for homeless families in order to support and sustain sobriety.

Eligibility: The targeted population is identified as homeless caretaking parents or pregnant women, referred by the Department of Transitional Assistance, who have physical custody of at least one child and who have a chronic substance addiction problem.     Section 18. There shall be a bureau of substance addiction services within the department.

    The bureau shall establish and advertise a free, anonymous and confidential toll-free telephone helpline that provides comprehensive, accurate and current information and referrals related to addiction treatment and prevention services. The helpline shall inform adult and juvenile callers on: acute treatment service facilities and transitional support service facilities that have open beds outpatient resources and community-based services. The helpline shall be a resource for emergency departments, health centers, families, social workers and medical professionals to obtain information on how to get treatment for an individual who is addicted to drugs or alcohol. The administration of the helpline shall be coordinated with other departments and agencies to prevent the duplication of similar services. The operation of the helpline may be contracted to third parties provided, however, that any such contracts shall be performance-based and subject to approval by the commissioner.

    BSAS does offer a list of forms, resources and regulations for Alcohol and Drug Treatment Programs but the list is very limited. BSAS website hosts some forms such as the Key Personnel Change Form, and the Regulatory and Contractual Waiver Request Form but, critically, not the application for licensure or the form for license renewal.     The Bureau of Substance Addiction Services’ Alcohol and Drug Counselor Licensing Unit provides licenses to alcohol and drug counselors , also referred to as substance addiction counselors or addiction counselors. The Unit receives and processes all counselor licensing applications and renewals and works closely with applicants throughout the licensing process. Unit staff is also available to provide technical assistance, verify license status and investigate complaints against licensed counselors.

    No facility can provide substance use disorder treatment in Massachusetts without a license provided by the Department of Mental Health . Programs must make applications for each facility, including satellite or medication units.

    Massachusetts state code specifies that licensed drug and alcohol treatment programs can be inspected at any time to determine if the facility, staff, and records meet state regulations and comply with the Commonwealths 105 CMR 164.00 code.

    Facilities or programs operating without a license in Massachusetts may be subject to penalties of $500 for the first offense and up to $1,000 for each additional offense, as well as imprisonment for not more than two years .

    Licensed facilities must submit an audit and provide a financial report to the Department of Mental Health each year on or before the 15th day of the fifth month at the end of the facilitys fiscal year.

    Massachusetts drug and alcohol program licensees must also adopt and maintain a written statement of purpose including goals, objectives, and program philosophy. The statement must be reviewed each year and modified when the program or clients served change.

    First Offender Driver Alcohol Education

    The Driver Alcohol Education programs are available to those individuals who agree to the alternative sentencing sanction as specified within Massachusetts General Laws for the offense of driving under-the-influence. Specifically, each DAE program participant is provided with a structured group where they receive educational material to help them identify and understand alcohol addiction issues and drinking-and-driving behaviors. While the major focus of these programs is on alcohol, other substances are also discussed. The program provides 40 hours of services conducted over 16 weeks and includes an assessment, participation in self-help and victim-impact community meetings.

    Eligibility: Individuals convicted for the first time for drunk driving and who choose this option as an alternative to losing their license or possible incarceration. Referrals are generally made by the adjudicating district court however, if the client is under 21, the Registry of Motor Vehicles may mandate the offender’s participation.

    Residential Treatment over 30 days are services for individuals who have recently stopped using alcohol and/or other drugs, have been stabilized medically and are able to participate in a structured residential treatment program.
