Cleanslate Addiction Treatment Centers Settle Allegations Of Unlicensed Prescribing And Improper Billing

BOSTON – The U.S. Attorneys Office reached a $750,000 civil settlement yesterday with CleanSlate Centers, Inc. and Total Wellness Centers, LLC d/b/a CleanSlate, to resolve allegations that the two companies, which together operate opioid addiction treatment centers in Massachusetts and other states, improperly prescribed for opioid addiction treatment and improperly billed Medicare.

CleanSlate operates 17 clinics, offering treatment to individuals addicted to opioids, including heroin and prescription painkillers, through medication and counseling. The medication, buprenorphine, is a Schedule III controlled substance that also can be used to treat pain. Until recently, only a physician could prescribe buprenorphine for addiction treatment. Congress modified the law in July 2016, allowing nurse practitioners and physician assistants to prescribe buprenorphine for addiction treatment, provided they meet certain training and state-law licensing requirements. In Massachusetts, those requirements have not yet been established.

United States Attorney Carmen M. Ortiz said, Buprenorphine is an important drug used in the treatment of substance abuse, and until recently, only physicians were allowed to prescribe it. We will continue to closely monitor clinics that use buprenorphine for addiction treatment to ensure that they comply with strict prescribing requirements.

However, in doing so, CleanSlate and Dr. Wilson studiously avoided the cost of medically necessary oversight, counseling, and individualized treatment.

As part of this scheme, Defendants mandate expensive urine drug tests at every patient visit. Defendants funnel these referrals to their own clinical laboratory. But, often, the results of these tests were not used to inform treatment decisions for patients. Moreover, in many instances, CleanSlate medical staff never reviewed the test results.

CleanSlate practices constitute healthcare fraud and exposed countless patients to serious medical harm. Our client, a former Divisional Medical Director, identified numerous troubling lapses of care. These include instances in which tests revealed use of drugs of abuse, indicative of significant relapse. However, these tests did not result in any change in care, or even acknowledgment by the responsible practitioners. In one particularly tragic case, Defendants policies led to the abandonment of a patient who lost their insurance and relapsed. Ultimately, this patient overdosed and died.

CleanSlates then Chief Medical Officer described evidence of these lapses as an unacceptable deviation from the standard of care. She also predicted that, We will and should crash as a company if this is the care we are providing.

A company that operates a network of addiction treatment centers has agreed to pay $4.5 million to settle allegations that it charged the Massachusetts Medicaid program for unnecessary urine drug testing that was illegally performed at the company’s own lab, officials said Thursday.

CleanSlate Centers, which operates more than 80 facilities in 10 states including 18 in Massachusetts, will pay $3.2 million to the state and $1.3 million to the federal government, the company and the state attorney general’s office said in separate statements.

As we face a worsening opioid crisis in Massachusetts, its important that treatment centers follow the rules and not cut corners to increase their bottom line, state Attorney General Maura Healey said. Our resolution with CleanSlate will bring millions of dollars back to the state and implement the oversight needed to protect patients and prevent these violations from happening again.”

Tennessee-based CleanSlate, which includes former U.S. Rep. Patrick Kennedy on its board of directors, denies any wrongdoing, liability or violating any laws, CEO Greg Marotta said in a statement.

We have chosen to settle this case due to the severe economic impact a prolonged legal battle would have had on the thousands of individuals and families we serve,” he said.

CleanSlate has served nearly 40,000 Massachusetts residents since 2009, and wants to focus on its primary mission.

Today, the Massachusetts Attorney Generals office announced that it has filed a Complaint in Intervention against CleanSlate Centers and its founder in a False Claims Act case filed by our client alleging fraud against Medicare and Medicaid. CleanSlate Centers operates a national chain of clinics in Massachusetts and nine other states. These clinics provide medication-assisted treatment for substance abuse, including opioid and alcohol addiction.

As described in our Amended Complaint, CleanSlate Centers exploited the national opioid epidemic in a scheme to build and operate a chain of for-profit addiction-treatment centers. Their own employees described them as a pill mill where physicians are expected to rubber stamp stacks of prescriptions. CleanSlate fraud and indifference to governing rules and regulations resulted in the government paying tens of millions of dollars for unnecessary, unreasonable, and often harmful medical procedures and laboratory tests.

Cleanslate Addiction Treatment Firm To Relocate Headquarters To Nashville

CleanSlate Centers, an out-patient opioid and alcohol addiction treatment company, is relocating its headquarters from western Massachusetts to Nashville as it embarks on a national expansion.

The eight-year-old company will move from Northampton, Mass., to the greater Nashvilel areato be closer to other health care services companies and talent, said Greg Marotta, the firm’s president and CEO. Marotta will be moving in early fall.

Nashville’s “deep history in health care services,” its location and supportive health care community attracted the company, Marotta said, adding that CleanSlate has relationships with consulting firms in the area.

“When I have met people in Nashville, what Ive always come away with is Nashville takes a great pride in being a health care city and will do anything they can to make sure you succeed, he said.

CleanSlate’s footprint includes 23 existing facilities in six states and 28 under development. It could have branches in more than a dozen states in the coming years. It doesn’t have any treatment facilities in Tennessee.

It’s a community-based medical practice with a focus on addiction. CleanSlate wants to be in-network with all the health plans in the states in which operates to give people as much access as possible. It also offers self-pay options for people who are uninsured or choose not to use their insurance.

“It’s a very indiscriminate disease, it does not pre-judge,” he said.

What Is Substance Misuse
