AUSTINTOWN, Ohio Michael Kukonik was addicted to heroin.

Its an addiction that started four years ago.

I got hurt when I was in Afghanistan. I had bulging disks bursitis in my hips, he said.

Kukonik was given pills to ease the pain, and when he couldnt get prescriptions for those pills anymore, he turned to heroin.

Now 64 days clean, Kukonik said its the longest that he has been sober since his addiction.

He had been trying to get help since 2015, but he said he would check into rehab facilities and sit in class all day long.

After the second or third class, you just lose focus. Youre out of it and dont even care anymore, he said. What I thought is, I just want to get high and forget about all of this.

His relapse happened just 20 minutes after he finished the 21-day program.

But at the California Palms Addiction Recovery Campus, Kukonik found a place where he could keep his focus.

He came to the facility on March 27. There, he attends a variety of different classes, like meditation and goal setting.

Director of Marketing Jennifer Weaver said those involved in the program can also get involved in physical activities, like kickboxing, yoga and water aerobics.

Kukonik said he can see how these programs are beneficial.

California Palms Sold For $4m At Sheriffs Sale

YOUNGSTOWN, Ohio The owner of the California Palms Addiction Recovery Campus is appealing a sheriffs sale of the property for $4 million to the Los Angeles-based Pender Capital Asset Based Lending Fund.

Documents from the Mahoning County Auditor show the sale closed April 2, and that the property was sold at sheriffs sale. This sale is the latest development in a legal dispute between the rehabilitation centers owner, Sebastian Rucci, and Pender Capital.

The case is on appeal and California Palms is progressing through that process, Rucci said in an email to The Business Journal. Rucci contends the sheriffs sale didnt comply with multiple statutory protections, he said.

We also respectfully believe that no lender has ever filed for foreclosure where their complaints admits that they are holding over one years interest, refuse to apply this to the loan, and refuse to return it, Rucci stated. As of this writing, we have not had one hearing in this case. We will continue to progress through the legal process which we respectfully believe is not concluded.

We are confident that the courts will not allow the foreclosure to conclude under these facts. Instead, in Ohio, a lender cannot file foreclosure without first providing that the loan is in default, we have the opposite, the lenders own words confirm that we were not in default.

On Jan. 12, California Palms sued Pender Capital claiming that the loan is usury, he said.

Documents filed in U.S. District Court are shedding some light on why Federal investigators searched the California Palms Addiction Recovery Campus in Austintown last October, seizing $600,000 from its bank accounts.

A complaint filed on Tuesday by the U.S. Attorney asks the court to force California Palms and operator Sebastian Rucci to forfeit $5,941,096 in Medicaid funds which investigators claim were fraudulently collected.

The government says Rucci and others billed Medicaid for services that were never provided and upcoded assessments to maximize Medicaid reimbursements. Upcoding occurs when a healthcare provider submits codes to Medicaid for more serious and more expensive diagnoses or procedures than the provider diagnosed or performed, according to prosecutors.

The complaint also alleges that the 200-bed facility billed Medicaid patients for services that extended beyond the limited thirty-day stay billed for urine screens that were not rendered, and used personnel without proper credentialing to sign off on patient assessments despite not seeing the patient, and billed Medicaid patients in exchange for free housing.

Patients who were assessed for 24-hour care for trained counselors to stabilize multidimensional imminent danger and prepare for outpatient treatment were often working outside of the California Palms facility or were used as laborers at California Palms, according to the complaint.

California Palms Hotel To Be An Addiction Recovery Center

AUSTINTOWN, Ohio The California Palms Hotel in Austintown will soon be an addiction recovery center.

The announcement came over social media on Friday when hotel owner Sebastian Rucci posted a video to his YouTube page.

The video says it will be called the California Palms Addiction Recovery Campus, adding that it will specialize in substance use treatment and focus on mental health.

California Palms Hotel has been a talking point of Austintown officials in the past because of various legal issues over several years.

It has also hosted drug awareness events in the past.

Most recently, things seemed to be going well, said Austintown trustee Jim Davis. So when this project initially came to light, we were kind of surprised. But this is a different venture for him and as long as they continue to cooperate with the procedure to get changed over, best wishes to them.

Davis added he thinks it will be a positive change for the community, especially with the heroin epidemic in the Valley.

Austintown already has Braking Point Recovery Center, but Rucci said California Palms will have a lot more beds close to 200 and a more campus-like atmosphere.
