A Certification Of Settlement Class

Before reaching the merits of the proposed settlement, the Court must ensure that the settlement class is certifiable. See Denney v. Deutsche Bank AG,443 F.3d 252, 270 and have been met.”). Plaintiffs seek to certify the following settlement class: all individuals employed by ARC Fund as hourly, non-supervisory employees in its residential drug rehabilitation centers in New York City between November 19, 1998, and April 1, 2005. Certifiability turns on whether Plaintiffs can satisfy the four Rule 23 requirements: numerosity, commonality, typicality, and adequacy of representation. FED. R. CIV. P. 23 see also Amchem Products, Inc. v. Windsor,521 U.S. 591, 613 . “arties seeking class certification must show that the action is maintainable under Rule 23, , or .” Amchem,521 U.S. at 614.

The numerosity criteria, which requires that joinder of all members is impracticable, see Robidoux v. Celani,987 F.2d 931, 935 , is satisfied. The putative class is sufficiently large because it consists of approximately 245 members, see Consol. Rail Corp. v. Town of Hyde Park,47 F.3d 473, 483 , and the value of the individual claims is sufficiently small. It is unlikely that this case would be brought by the individual class members since, on the individual level, it is of small monetary value as compared to the burdens of litigation.

For all of these reasons, the settlement class is certifiable.

B Merits Of The Proposed Settlement

While judicial policy favors the settlement of class actions, see In re Paine Webber Ltd. P’ships Litig.,147 F.3d 132, 138 , Courts may not “rubber stamp approval in favor of an independent evaluation,” City of Detroit v. Grinnell Corp.,495 F.2d 448, 462 , overruled on other grounds by Missouri v. Jenkins by Agyei,491 U.S. 274, 285 . “Before such a settlement may be approved, must determine that a class action settlement is fair, adequate, and reasonable, and not a product of collusion.” Joel A. v. Giuliani,218 F.3d 132, 138 . The Court “determines a settlement’s fairness by examining the negotiating process leading up to the settlement as well as the settlement’s substantive terms.” D’Amato v. Deutsche Bank,236 F.3d 78, 85 . The Court also minds these nine factors to evaluate whether a settlement is sound:

the complexity, expense and likely duration of the litigation the reaction of the class to the settlement the stage of the proceedings and the amount of discovery completed the risks of establishing liability the risks of establishing damages the risks of maintaining the class action through the trial the ability of Defendants to withstand a greater judgment the range of reasonableness of the settlement fund in light of the best possible recovery the range of reasonableness of the settlement fund to a possible recovery in light of all the attendant risks of litigation.

Federal Poverty Guidelines For 2022

Persons In Family Household Poverty Guideline Salary per year

For Households with more than 8 persons, add $4,480 for each additional person. *Alaska and Hawaii have different rates for HUD federal poverty guidelines. These numbers above represent 100% of the Federal Poverty Rate. In order to get reduced or free treatment from some substance abuse centers, they use a sliding fee scale based on your income. When they use a sliding fee scale, the 100% rate can be different than 100%. In those cases, using for example a 200% federal poverty level, you will only need double the 100% number listed above to 200%.

Tax Filings And Audits By Year

New Bridge Foundation®

The IRS Form 990 is an annual information return that most organizations claiming federal tax-exempt status must file yearly. Read the IRS instructions for 990 forms.

If this organization has filed an amended return, it may not be reflected in the data below. Duplicated download links may be due to resubmissions or amendments to an organization’s original return.

Nonprofit organizations that spend $750,000 or more in Federal grant money in a fiscal year are required to submit an audit covering their finances and compliance. Some of these are program specific, while others, called single audits, look at the entire organization. Nonprofit Explorer has PDFs of these audits for some nonprofits for fiscal year 2015 and later. Theyre provided by the Federal Audit Clearinghouse.

  • The Internal Revenue Service is substantially delayed in processing and releasing nonprofit filings, so documents available here may not be the most recent an organization has filed. ProPublica posts new tax forms as they are released by the IRS.

Npi Validation Check Digit Calculation

The following table explains the step by step NPI number validation process using the ISO standard Luhn algorithm.

Start with the original NPI number, the last digit is the check digit and is not used in the calculation.
Step 1: Double the value of the alternate digits, beginning with the rightmost digit.
2 0 12
Step 2: Add all the doubled and unaffected individual digits from step 1 plus the constant number 24.
2 + 9 + 2 + 2 + 6 + 7 + 1 + 2 + 0 + 1 + 2 + 24 = 58
Step 3: Subtract the total obtained in step 2 from the next higher number ending in zero, the result is the check digit.
60 – 58 = 2 2

The NPI number 1912376062 is valid because the calculated check digit 2 using the Luhn validation algorithm matches the last digit of the original NPI number.

B The Availability Of A Less Intrusive Alternative

Lakeview Health | Treatment for Substance Abuse

Defendants contend that plaintiffs have no need to access the non-relevant information on the discs because they will produce, in paper form, records which contain the relevant information. They describe this production as comprising forty-six boxes and approximately 36,000 pages. Defendants maintain that they cannot provide a time frame for the review and disclosure of responsive documents, but there seems little doubt that the time and cost expenditure could be disproportionate to the interests sought to be protected. The undertaking is made more difficult since defendants insist that the material must be reviewed on premises.

An indication of the magnitude of the task is that defendants assert that they have not had the time or personnel to review their own production. While some of the difficulty results from staff reductions, it has been four months since plaintiffs submitted their requests.

In contrast, plaintiffs could make duplicates of the computer discs quickly and inexpensively. These discs could then be reviewed in a more efficient manner and the sensitive information skipped by the reviewer. Admittedly, this means that the individual reviewing the computer files could look at the personal data, but the confidentiality order addresses this concern.
