Town of Hyde Park,47 F.3d 473, 483 , and the value of the individual claims is sufficiently small. It is unlikely that this case would be brought by the individual class members since, on the individual level, it is of small monetary value as compared to the burdens of litigation.

Deutsche Bank,236 F.3d 78, 85 . The Court also minds these nine factors to evaluate whether a settlement is sound:

the complexity, expense and likely duration of the litigation the reaction of the class to the settlement the stage of the proceedings and the amount of discovery completed the risks of establishing liability the risks of establishing damages the risks of maintaining the class action through the trial the ability of Defendants to withstand a greater judgment the range of reasonableness of the settlement fund in light of the best possible recovery the range of reasonableness of the settlement fund to a possible recovery in light of all the attendant risks of litigation.

I. INTRODUCTION

Plaintiffs Sharon Gilliam, Trina Grant, and Timothy Mitchell, individually, and on behalf of others similarly situated, bring this action against defendants Addicts Rehabilitation Center Foundation, Inc. , Addicts Rehabilitation Center Fund, Inc. , and James Allen . Plaintiffs filed the complaint on April 1, 2005, alleging defendants failed to compensate them for work they performed in violation of the Fair Labor Standards Act and New York Labor Law. Before the Court is plaintiffs’ motion to amend the complaint pursuant to Rule 15, Federal Rules of Civil Procedure. For the reasons which follow, plaintiffs’ request is GRANTED.

The addition of new parties to an action is governed by Rule 21, which provides that “arties may be dropped or added by order of the court on motion of any party or of its own initiative at any stage of the action and on such terms as are just.” See alsoChowdhury v. In deciding whether a party may be added under this rule, the Court is guided by “the same standard of liberality afforded to motions to amend pleadings under Rule 15.” Soler v. GY, Inc.,86 F.R.D. 524, 528 . Rule 21 provides that the Court has discretion to determine whether additional parties should be included in a pending action. Id. at 528.

Defendants contend that plaintiffs have no need to access the non-relevant information on the discs because they will produce, in paper form, records which contain the relevant information. They describe this production as comprising forty-six boxes and approximately 36,000 pages. Defendants maintain that they cannot provide a time frame for the review and disclosure of responsive documents, but there seems little doubt that the time and cost expenditure could be disproportionate to the interests sought to be protected. The undertaking is made more difficult since defendants insist that the material must be reviewed on premises.

An indication of the magnitude of the task is that defendants assert that they have not had the time or personnel to review their own production. While some of the difficulty results from staff reductions, it has been four months since plaintiffs submitted their requests.

In contrast, plaintiffs could make duplicates of the computer discs quickly and inexpensively. These discs could then be reviewed in a more efficient manner and the sensitive information skipped by the reviewer. Admittedly, this means that the individual reviewing the computer files could look at the personal data, but the confidentiality order addresses this concern.
